If buying a resale property do the sellers have to provide a licence of first occupation. The property is legal and urbanised.

I don't think Chiclana has ever issued a Licence of First Occupation but stand to be corrected; to get such a licence the building has to have had a licence to build, be connected to drinking water, sewerage and electricity and be signed of by an architect.
As we haven't got a PGOU town plan, I don't think it is possible to get one - yet

We purchased a resale property in Chiclana last year and our lawyer absolutely insisted on the seller producing a certificate of first occupation. We withheld money from the sale until this came through which it eventually did after several months of waiting. So I would suggest you ask for one.

In order to have got legal water and electricity the house will have been granted a First occupancy certificate but isn't always asked for, for a property over 10 years old. (I say this from experience, as we sold a 25 year old property and did not have to provide one but a different case buying a house less than 10 years old!)
So yes Davefx they are issued, we have one for a property purchased in the last 18 months as you cant legally get electricity and mains water without one! However to get one the property has to have all bathroom, kitchen plumbing in place and all electric sockets in place, its a very weird system. Also the house has to have front and back doors and be secure with windows in place (in our case even in places you didn't want to keep them)!

The house we received certificate of First Occupancy for is more than 10 years old so I'm not sure about Hobo's mention of not needing one for houses older than 10 years. A good lawyer, such as the one mentioned in the other thread, will keep you right rather than depending on hearsay.

Chiclana issue LOFOs. They supplied me with a copy through my abogado that I needed for registering as a Villa Touristica.
