Would anyone be able to recommend a solicitor in the Chiclana area who has worked on, or is working on, their case in respect of the clausula suelo (floor clause) to obtain a refund from the bank of the overpayments and set up costs?
Many thanks in advance.

Realise that but I take it that you don't know of anyone who has used or is using them to pursue their case?
After all, it's no secret that it affects millions of Spanish mortgage holders, even if you have since sold. Your bank is certainly not going to tell you about it nor suddenly credit your account with thousands of euros!!

I had a meeting with Temple Cambria this afternoon on a different matter. But I asked the question and was told that the person in their office dealing with mortgage issues is Francisco Javier Gomez Calvo. His email is fjavier@templecambria.com. Good luck!

I previously had a mortgage with a well known bank. Can a claim be made after nearly 7 years?

We have taken a claim to court (this was before the High Court ruling) that made things a lot more straightforward. I won't go into the details here because the process has changed since then. Our case has not yet finished due to various complications and appeals by the bank, however, the judgments that we have had have all been in our favour. However, banks have the funds to appeal to the nth degree and they do so. We used ASUFIN, a legal group set up to fight the banks and these abusive clauses. They have had a lot of success and absolutely know their stuff. It's because of their diligent efforts over the past 8 years or so and other legal groups like them who have been taking these cases through the courts since 2009 or so; that the Supreme Court finally ruled that these clauses are abusive and the banks have been forced to make good people's losses. asufin.com/We are not with ASUFIN any more - not because we weren't happy with them but because the lawyer dealing with our case left ASUFIN and we decided to stick with her as she was familiar with all the details of our case and we had received judgments in our favour under her care. However, I'm sure that all the lawyers with ASUFIN are experts in this field as they deal with these cases all the time. When we were with ASUFIN they offered various options and capped their fees, they may now even offer no win/no fee. Their lawyers speak excellent english. Patricia Suarez, who is one of the founders of the ASUFIN group is known as WonderWoman and rightly so... she's the David to the Bank's Goliath...
